7. LAWFUL BASES FOR USING PERSONAL INFORMATION
UK data protection law requires Kanvss to have a lawful basis for using personal information.
7.1 Steps before entering a contract and performance of a contract
Kanvss may use personal information where necessary to:
• respond to a request about possible services;
• arrange an introductory discussion;
• understand your requirements;
• prepare a proposal;
• establish an engagement; or
• provide agreed services.
7.2 Legitimate interests
Kanvss may use personal information where necessary for a legitimate business purpose, provided that purpose is not overridden by your rights and interests.
Relevant legitimate interests may include:
• responding to business enquiries;
• administering a voluntarily completed Readiness Check;
• reviewing responses and requested follow-up;
• developing prospective client relationships;
• managing professional relationships;
• operating and improving Kanvss;
• protecting business systems and information;
• maintaining proportionate business records;
• understanding how the website and services are used; and
• establishing, exercising, or defending legal rights.
Before relying on legitimate interests, Kanvss considers the purpose, necessity, reasonable expectations, nature of the information, and possible effect on the person concerned.
7.3 Consent
Kanvss may rely on consent where you are offered a genuine and optional choice.
This may include consent to:
• receive occasional Kanvss insights and marketing updates; or
• permit non-essential cookies and analytics.
You may withdraw consent at any time.
Withdrawing consent does not affect the lawfulness of processing that took place before consent was withdrawn.
7.4 Legal obligation
Kanvss may use or retain information where necessary to comply with legal duties, including duties concerning:
• taxation;
• accounting;
• data protection;
• fraud prevention;
• legal proceedings; and
• lawful requests from courts, regulators, or public authorities.
8. THE FUTURE BUYER READINESS CHECK
The Future Buyer Readiness Check is an introductory reflection tool designed to help business owners consider how a future buyer might view aspects of their business.
When you complete the Check, Kanvss may collect:
• your contact and business details;
• your selected answers;
• your calculated score;
• optional reflections;
• your request for contact, where selected; and
• your marketing preference, where selected.
Kanvss uses this information to:
• operate the Check;
• calculate and display your score;
• understand the themes identified by your answers;
• contact you where you have requested a conversation;
• improve the Check and related Kanvss services; and
• send insights and updates where you have made the appropriate choice.
The Reflection and Next Steps questions are optional. You do not need to answer them to receive your score.
Please keep optional responses high-level and do not include confidential, sensitive, or unnecessary information.
Completing the Check does not automatically subscribe you to marketing.
Your request for a Buyer Readiness Conversation is separate from your choice about receiving Kanvss insights and updates.
9. READINESS CHECK DISCLAIMER
The Future Buyer Readiness Check is an introductory reflection tool.
It is not:
• a business valuation;
• a formal appraisal;
• a due-diligence exercise;
• an audit;
• a regulated financial assessment; or
• legal, accounting, taxation, financial, investment, or other regulated professional advice.
The score and responses should not be relied upon as the sole basis for a significant business, financial, legal, taxation, investment, succession, or sale decision.
Where appropriate, you should obtain advice from a suitably qualified professional.
10. TALLY
The Future Buyer Readiness Check is provided through Tally, an online form service operated by Tally BV in Belgium.
When you complete the Check, Tally processes and stores the information submitted through the form on behalf of Kanvss.
For this activity:
• Kanvss is the data controller; and
• Tally acts as a data processor.
Tally states that form information is encrypted in transit and at rest and stored in Europe.
Tally uses approved service providers to supply elements of its service. These may include hosting, storage, and email-notification providers.
When email notifications are enabled, the complete submission may be included in an email sent to Kanvss. Information contained in these notifications may be processed by Tally’s email-notification provider outside the United Kingdom.
Kanvss controls how long identifiable Readiness Check submissions remain available in its Tally account.
Tally states that deleted submissions are permanently removed from its backups within its normal backup-deletion period.
11. READINESS CHECK EMAIL NOTIFICATIONS
Kanvss currently receives a notification email containing the submitted Readiness Check response.
A submission may therefore be held in:
• the Kanvss Tally account; and
• the Kanvss email account.
The Kanvss email account is subject to access and security controls.
Kanvss does not intentionally forward or distribute complete submissions unless this is necessary and appropriate.
Email copies are managed under Kanvss retention and deletion procedures and should not be kept as unnecessary permanent duplicates.
12. CONTACT FORMS AND ENQUIRIES
When you submit a website contact form or contact Kanvss directly, Kanvss uses the information you provide to:
• understand your enquiry;
• respond to you;
• provide requested information;
• arrange further contact where appropriate; and
• maintain a proportionate record of the communication.
Submitting an enquiry does not automatically subscribe you to marketing.
Please do not include sensitive personal information or confidential business information that is not necessary for Kanvss to respond.
13. MARKETING COMMUNICATIONS
Kanvss may send occasional insights, updates, invitations, or promotional information where permitted by law.
Where consent is required, these communications will be sent only after you have actively chosen to receive them.
Your marketing choice is kept separate from:
• completing the Future Buyer Readiness Check;
• receiving your score;
• asking Kanvss to contact you;
• submitting a general enquiry; and
• becoming a client.
You may unsubscribe at any time by:
• using an unsubscribe facility included in a marketing email; or
• emailing info@kanvss.com.
Kanvss may retain a minimal suppression record after you unsubscribe so that your preference can continue to be respected.
14. COOKIES AND WEBSITE ANALYTICS
The Kanvss website uses cookies and similar technologies.
Some cookies are essential because they enable the website to:
• operate correctly;
• maintain security;
• remember privacy choices; or
• provide functions requested by visitors.
Other cookies may be used for analytics, performance, or related non-essential purposes.
Where consent is required, non-essential cookies are restricted unless you choose to accept them.
The website provides accessible choices to accept or reject non-essential cookies.
You can change or withdraw your cookie preference through the cookie controls provided on the website.
Squarespace provides the Kanvss website platform and may process technical and website-use information to operate, secure, maintain, and support the website.
Further information is available in the Kanvss Cookie Policy.
15. SQUARESPACE
The Kanvss website is hosted and supported by Squarespace.
Squarespace may process website visitor and account information to provide:
• website hosting;
• security;
• technical operation;
• form and communication functions;
• cookie preference controls;
• website performance functions; and
• analytics where enabled and permitted by the visitor’s cookie choice.
Squarespace may use approved service providers and subprocessors in providing these services.
16. AUTOMATED SCORING
The Future Buyer Readiness Check uses pre-set scoring rules to calculate a score from the answers selected.
The score does not make a legal, contractual, financial, employment, lending, insurance, or similarly significant decision about you or your business.
Any subsequent interpretation, discussion, recommendation, or Kanvss work involves human judgement.
Kanvss does not use the Readiness Check to make decisions producing legal or similarly significant effects solely through automated processing.
17. USE OF ARTIFICIAL INTELLIGENCE
Kanvss may use carefully selected artificial intelligence tools to assist with:
• administration;
• research;
• drafting;
• analysis;
• summarisation; and
• document preparation.
Artificial intelligence does not replace professional judgement.
David Fenner remains responsible for Kanvss conclusions, recommendations, and materials.
Kanvss seeks to minimise the personal and confidential information entered into artificial intelligence systems.
Where reasonably possible, information will be anonymised, pseudonymised, or stripped of identifying details before an artificial intelligence tool is used.
Kanvss does not intentionally enter special-category or highly sensitive personal information into artificial intelligence systems unless there is a clear lawful purpose and appropriate protection.
AI-assisted work is subject to human review before it is relied upon or issued as Kanvss work.
18. WHO KANVSS MAY SHARE INFORMATION WITH
Kanvss does not sell personal information.
Kanvss may share information with selected providers where necessary to operate the business and provide its services.
These may include:
• Squarespace;
• Tally;
• email and communication providers;
• cloud storage and document-management providers;
• accounting, bookkeeping, banking, and payment providers;
• information technology and security providers;
• professional advisers, including solicitors, accountants, and insurers;
• artificial intelligence providers, where appropriately controlled;
• contractors or associates working under appropriate confidentiality and data protection obligations; and
• courts, regulators, law-enforcement bodies, and public authorities where disclosure is required or permitted by law.
Information may also be disclosed where reasonably necessary to:
• protect Kanvss’s legal rights;
• investigate suspected fraud, misuse, or security incidents;
• comply with legal proceedings or lawful requests; or
• support a future sale, merger, restructuring, or transfer of the Kanvss business.
Where a business transfer is contemplated, appropriate confidentiality, due-diligence, and data protection controls will be applied.
19. INTERNATIONAL PROCESSING AND TRANSFERS
Some Kanvss service providers or their subprocessors may process information or provide support access from outside the United Kingdom.
Where a restricted international transfer takes place, Kanvss seeks to ensure that an appropriate legal mechanism or safeguard applies.
Depending on the destination and provider, this may include:
• UK adequacy regulations;
• approved contractual safeguards;
• the UK International Data Transfer Agreement;
• the UK Addendum to approved standard contractual clauses; or
• another mechanism recognised under UK data protection law.
Tally is based in Belgium and states that its core form information is stored in Europe.
Information included in form-notification emails may also be processed by an email service provider outside the United Kingdom.
20. HOW LONG KANVSS KEEPS INFORMATION

Information will be deleted or securely anonymised when it is no longer required.
21. HOW KANVSS PROTECTS INFORMATION
Kanvss uses proportionate technical and organisational safeguards intended to protect personal information against:
• unauthorised access;
